Terms of Service - Habits by dini

1. Agreement to Terms

By downloading, installing, accessing, or using the Habits by dini mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Service

Habits by dini is a mobile application that allows users to:

Create and track daily habits
Build streaks and monitor progress
View analytics and insights
Connect with friends and participate in challenges (if applicable)
Access premium features through subscription

We reserve the right to modify, suspend, or discontinue any part of the App at any time without prior notice.

3. User Accounts and Registration

To use certain features of the App, you must register for an account. You agree to:

Provide accurate, current, and complete information
Maintain and update your information to keep it accurate
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

4. Premium Subscriptions

4.1 Subscription Plans

We offer Premium subscriptions with the following options:

Monthly Premium: Billed monthly, recurring until cancelled
Yearly Premium: Billed annually, recurring until cancelled

4.2 Payment and Billing

Subscription fees are processed through:

Apple App Store: For iOS users, subscriptions are managed through Apple's App Store. Payment will be charged to your Apple ID account at confirmation of purchase.
Google Play: For Android users, subscriptions are managed through Google Play. Payment will be charged to your Google Play account at confirmation of purchase.

4.3 Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions through:

iOS: Settings → [Your Name] → Subscriptions
Android: Google Play Store → Subscriptions

4.4 Free Trial

If we offer a free trial period, it will be specified at the time of sign-up. At the end of the free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

4.5 Price Changes

We reserve the right to change subscription prices at any time. Price changes will apply to subsequent subscription periods. We will notify you of any price changes with reasonable notice, typically via email or in-app notification.

4.6 Refunds

Refund policies are governed by the platform you use:

Apple: Refunds are subject to Apple's refund policy. Contact Apple Support for refund requests.
Google: Refunds are subject to Google Play's refund policy. You may be eligible for a refund within 48 hours of purchase through Google Play.

We do not provide direct refunds. All refund requests must be processed through the platform (Apple or Google) from which you purchased the subscription.

4.7 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to Premium features until the end of the period you have already paid for. No refunds will be provided for the unused portion of a subscription period.

5. Acceptable Use

You agree not to:

Use the App for any illegal purpose or in violation of any laws
Interfere with or disrupt the App or servers
Attempt to gain unauthorized access to any portion of the App
Use automated systems (bots, scrapers) to access the App
Impersonate any person or entity
Upload or transmit any viruses, malware, or harmful code
Harass, abuse, or harm other users
Share your account credentials with others

6. User Content

You retain ownership of any content you create or upload to the App (such as habit names, notes, or custom data). By using the App, you grant us a license to:

Store, process, and sync your content across your devices
Use your content to provide and improve our services
Create anonymized, aggregated data for analytics and improvements

You are solely responsible for your content and ensure it does not violate any third-party rights or applicable laws.

7. Intellectual Property

The App, including its design, features, and content, is owned by DINI AI Inc. and protected by copyright, trademark, and other intellectual property laws. You may not:

Copy, modify, or distribute the App
Reverse engineer or attempt to extract source code
Use our trademarks, logos, or branding without permission
Create derivative works based on the App

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

The App will be uninterrupted or error-free
Defects will be corrected
The App is free of viruses or other harmful components

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

Your use or inability to use the App
Any unauthorized access to or use of our servers or data
Any errors or omissions in the App
Any loss or damage resulting from your use of the App

10. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including:

Breach of these Terms
Fraudulent, abusive, or illegal activity
At our sole discretion

Upon termination, your right to use the App will cease immediately. You may also terminate your account at any time by deleting the App or contacting us.

11. Platform-Specific Terms

11.1 Apple App Store

If you downloaded the App from the Apple App Store, you acknowledge that:

These Terms are between you and DINI AI Inc., not Apple
Apple is not responsible for the App or its content
Apple has no obligation to provide support for the App
In the event of App failure, you may notify Apple for a refund

11.2 Google Play

If you downloaded the App from Google Play, you acknowledge that:

These Terms are between you and DINI AI Inc., not Google
Google is not responsible for the App or its content
You must comply with Google Play's Terms of Service

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through appropriate legal channels.
